Hedge Stars Aberdeen

These Terms and Conditions (“Agreement”) govern the provision of gardening, hedge cutting, landscaping, and associated services (“Services”) by Hedge Stars Aberdeen (“Contractor”, “we”, “us”, or “our”) to the Client (“you” or “your”). By engaging our Services, you agree to be bound by the following terms:

1. Scope of Services

1.1 Services will be provided as agreed in writing, verbally, or by acceptance of a quotation.
1.2 Any additional work requested outside the agreed scope shall be subject to separate quotation and charge.
1.3 Contractor reserves the right to determine the most appropriate tools, methods, and schedule to complete the Services.

2. Quotations & Pricing

2.1 All quotations are valid for 30 days unless otherwise specified.
2.2 Prices may be adjusted if:

• The nature of the work differs materially from the Client’s description,

• Access, site conditions, or hazards were not disclosed,

• Additional waste removal or specialist equipment is required.
  2.3 All prices are exclusive of VAT unless expressly stated.

3. Payment Terms

3.1 Payment is due within 7 calendar days of completion of Services unless otherwise agreed in writing.
3.2 Late payments may incur interest at 8% per annum above the Bank of England base rate plus recovery costs.
3.3 Failure to pay within 14 days entitles Contractor to suspend or terminate further Services without liability.

4. Cancellations & Postponements

4.1 Cancellations made less than 48 hours before scheduled work may incur a charge of up to 50% of the quoted fee.
4.2 Postponements due to weather or circumstances beyond Contractor’s control will be rescheduled without penalty.
4.3 Contractor shall not be liable for delays caused by events outside reasonable control (force majeure).

5. Client Responsibilities

5.1 The Client shall ensure:

• Safe and reasonable access to the property,

• All hazards (e.g. uneven ground, sharp objects, hidden cables) are disclosed,

• Domestic pets and children are kept away from the working area,

• Necessary permissions (planning, neighbour consents, landlord approvals) are obtained prior to work.
  5.2 Failure to provide access or site readiness may result in additional charges.

6. Waste & Disposal

6.1 Standard services include removal of green waste unless otherwise stated in the quotation.
6.2 Additional disposal requirements (e.g. large volumes, restricted access) may incur extra charges.

7. Health & Safety

7.1 Contractor complies with applicable health and safety legislation.
7.2 The Client agrees not to enter the immediate work area unless authorised.
7.3 Contractor reserves the right to cease work immediately if conditions are unsafe.

8. Liability & Insurance

8.1 Contractor carries appropriate public liability insurance.
8.2 Liability is limited to the value of the Services provided and excludes:

• Indirect or consequential losses,

• Damage to property not directly caused by negligence,

• Pre-existing conditions, hidden obstructions, or underground utilities not disclosed.
  8.3 Client indemnifies Contractor against claims arising from Client’s breach of this Agreement.

9. Guarantees

9.1 No guarantee is given for living materials (plants, hedges, lawns, etc.) due to factors outside Contractor’s control (weather, soil conditions, pests, aftercare).
9.2 Workmanship complaints must be reported in writing within 7 days of completion.

10. Termination

10.1 Either party may terminate with 7 days’ written notice.
10.2 Contractor may terminate immediately for non-payment, unsafe conditions, or breach of Client responsibilities.

11. Data Protection

11.1 Client data will be processed in accordance with the UK GDPR and Data Protection Act 2018.
11.2 Contractor may retain Client details for quotation, invoicing, and service records.

12. Governing Law & Jurisdiction

12.1 This Agreement shall be governed by the laws of Scotland.
12.2 Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.

By engaging Hedge Stars Aberdeen, the Client acknowledges having read, understood, and agreed to these Terms and Conditions.
